Pursuant to Article 31, Paragraph 31.1 of the Annex to the Convention Governing the WAMU Banking Commission, where the Banking Commission determines that banking regulations or any other legislation applicable to credit institutions, financial companies, decentralized financial systems, electronic money institutions, or any other entity under its supervision within a Member State have been breached, it shall inform the Minister of Finance of that State and, without prejudice to any applicable criminal or other penalties, shall impose one or more of the following regulatory sanctions :
- a warning ;
- a reprimand ;
- the total or partial suspension or restriction of operations ;
- any other limitations on the conduct of banking business ;
- the suspension or mandatory resignation of the responsible executive officers ;
- a prohibition barring the responsible individuals from directing, administering, or managing an institution under its supervision or any branch thereof. Depending on the severity of the offense, such prohibition may be permanent or temporary, and may be imposed even after the aforementioned individuals have been removed from office ; or
- the withdrawal of license or establishment authorization.
