Where the Banking Commission finds that a covered institution has failed to comply with the rules of professional conduct, compromised its financial soundness, engaged in unsafe or unsound management practices, or no longer meets the conditions required for its licensing or authorization, as the case may be, the Banking Commission may, after notifying the Minister of Finance of the State concerned, issue to the regulated institution :
- a warning ; or
- an injunction to adopt or implement, within a specified timeframe, the necessary corrective actions or any appropriate protective measures.
Administrative measures are legally binding. Any regulated institution that fails to comply with an administrative measure shall be deemed to be in breach of the regulations in force.
