In addition to regulatory sanctions, the WAMU Banking Commission may impose pecuniary penalties, the amounts of which shall be determined by an Instruction of the Central Bank. These penalties shall be collected by the Central Bank.
Pecuniary penalties may only be imposed in conjunction with an issued regulatory sanction.
The maximum pecuniary penalty that the WAMU Banking Commission may impose on a covered institution shall be established by an Instruction of the Central Bank. This maximum ceiling may vary depending on whether the entity concerned is a credit institution, a financial company, an electronic money institution, or a decentralized financial system (DFS). The Corporate Central Bank Instruction classifies infractions into three categories and determines the quantum of the penalty accordingly. In the event of multiple concurrent infractions, the aggregate amount of such penalties may not exceed the maximum cap established by the Central Bank.
The collection procedure for pecuniary penalties is defined by the Central Bank based on the category of the covered institution. This procedure varies depending on whether or not the institution concerned maintains an account with the Central Bank. Only credit institutions hold such accounts.
